Cobb police: Jogger killed after crossing against light

VININGS — Cobb police say a jogger did not have the right of way when she crossed into the path of an oncoming pickup truck — a decision that cost the woman her life.

The jogger has been identified as Cary A. Scales, 40, of Smyrna.

Witnesses told police Scales had been jogging on the sidewalk of Woodland Brook Drive near Paces Ferry Road on Thursday just before 8 a.m. She attempted to cross Paces Ferry at the intersection, but went against the traffic light, police said.

Police said Scales was then struck by a gray 2004 Nissan Titan truck, which was traveling westbound on Paces Ferry.

Scales was taken to the Atlanta Medical Center in serious condition, but died Friday of her injuries, police said.

Police said the driver of the Nissan is not being charged.
