Unlicensed Florida day care owner sentenced

JACKSONVILLE, Fla. (AP) — An unlicensed day care owner will spend two days a year in jail every year for the next ten years after a 2-year-old drowned while under her care.

A judge sentenced Jan Marie Buchanan to spend the child's birthday and also the anniversary of his death in jail each year. The 46-year-old pleaded guilty Wednesday to culpable negligence in the death of Steven Spurlock.

Under the agreement, prosecutors dropped charges of aggravated manslaughter of a child and operating an unlicensed day care facility.

The Florida Times-Union reports Buchanan operated Kiddie Heaven out of her Jacksonville area home. She told police she had taken seven kids to swim for about an hour last summer. When they went inside, she was taking care of an infant and lost sight of Steven for several minutes.
