The Face of Kennesaw Museum fights his termination in court

KENNESAW — Kennesaw’s Southern Museum of Civil War and Locomotive History and arguably its most well-known employee are at odds over his recent firing.

On Wednesday, former lead interpreter Harper Harris appealed the museum’s decision to fire him after 15 years at a hearing before Kennesaw Municipal Court Judge Philip Taylor. The museum alleges that Harris did not meet its performance standards.

During the nearly three-hour appeal hearing at City Hall, Harris, dressed in a vest and cowboy boots, said he’d rarely had a bad performance review until museum Executive Director Dr. Richard Banz and Director of Operations Dena Bush began writing him up in the past two years over a series of alleged mistakes.

He was informed in a May 17 letter that he was immediately terminated.

“I was really surprised because I thought I had been doing a good job in evaluations and stuff,” testified Harris, 59. “I felt like I was just being railroaded out.”

Harper said he was appealing to get his job back.

After the famed “The General” locomotive at the center of its collection, Harris was perhaps the most recognizable figure at the museum. With his trademark goatee and long hair, he often greeted visitors in period costumes, gave tours and participated in various Civil War-related events in and outside the city. He also appeared as an extra in about 20 films and TV productions.

The Sprayberry High School graduate’s relationship with the museum began as a teenage volunteer when the present museum was nothing more than an old cotton gin. In the early 1970s, he was there when “The General” was rolled into the museum and watched as it was expanded in the mid-90s.

The city of Kennesaw owns the museum.

In 1997, Harris began formally working for the museum after being employed by Cobb EMC and briefly working as a collector in the city’s water department. Though he had no college education, Harris said he gained his passion and knowledge of the Civil War era through study and as a longtime re-enactor, which had impressed museum leadership.

He was paid $23.50 per hour and received benefits as one of nine full-time city employees at the museum.

But that wasn’t enough to keep him at the museum, whose leaders heaped a large amount of paperwork onto his job duties to take advantage of his lack of administrative experience, argued Howard Evans, his Dunwoody attorney. He asserted that Harris’ popularity was a cause of jealousy among his superiors.

“In relation to Mr. Harris’ primary function and duties, the (performance improvement plan) goes off-track and attacks reportedly his administrative and educational weaknesses,” Evans said.

“The evidence could be inferred that because Mr. Harris was the face, heart and soul of the museum, there was personal jealously. This is a personal termination. It’s not one where the circumstances of performance warrant termination.”

But Jamie Wingler, the city’s attorney, presented a series of examples of what he described as deficiencies that led Banz and Bush to place Harris on a 90-day performance improvement plan back in February and ultimately fire him for a lack of improvement.

Among those charges, which Harris refuted, were frequent tardiness and absences, difficulty filing paperwork, mismanaging programs, placing a racially offensive noose at his desk, making sexual comments to a visitor breastfeeding, having pornography on his office computer, leaving weapons unattended and insubordination, particularly related to women such as Bush, his immediate supervisor.

In April 2010, Banz was hired as director of education and promoted eight months later to executive director of the museum. He testified and was cross-examined for an hour about his decision to fire Harris, whom he credited with being personable with visitors, but lacked the professionalism required of a museum employee.

“Mr. Harris felt that he did not need to report to a supervisor,” Banz recalled of a meeting last December. “I was advised by Jeff Drobney, the previous executive director, that there had been a problem with Mr. Harris and female supervisors dating back to 2004.”

Though Bush — who was hired in October — admitted under cross-examination that Harris received many letters of praise from visitors, she also testified she had difficulty working with him because he failed to sufficiently improve after negative performance reviews.

Evans called three witnesses to testify on behalf of Harris, including former museum employee Jeanetta Jones, who testified she also had problems with Bush; former Cobb deputy police chief Bully Mull, who said Harris was a museum asset who didn’t deserve to be fired; and Kennesaw Museum Foundation trustee David Burns.

“My biggest issue is that I’ve known Harper for a long time and I’ve seen his heart, desire and love for The General,” said Burn, who shared two stories of Harris’ devotion to his job.

“You have a man who is so passionate about the museum, so passionate that the museum put his name on The General store in the education center. To my knowledge, he’s the only individual staff member that’s in the movie. If you Google Harper Harris, you will see his name six or seven times and picture receiving the Kennesaw Heritage Award.”

Founded in 1998, the foundation provides support and funding for the programs and exhibitions of the museum. Paul Chastain, president of the 35-member foundation board, declined to comment on the matter when asked by the Journal.

In his closing statement, Wingler said that Harris simply refused to live up to the expectations placed on him by the city, though given multiple opportunities to improve.

“It’s interesting that he thought the PIP was put in place for him to be terminated and had all these fears about being terminated, yet it appears that he spent more time talking to people about his situation than actually doing the paperwork that was required of him,” Wingler said.

Judge Taylor said he will issue his opinion in the matter within seven days.

It sure seems to me that a lot of the older people were the ones replaced at the museum. I sure hope this does not turn into another lawsuit, this time on age discrimination because we just cannot afford to pay any more legal fees.

"Call it like it is"' good morning. I agree many foundation members seldom visit the museum. You can't put me in that group. I am in the museum often. You mentioned several things that I was not in attendance, and you were correct on all of them but Trains, Trains, Trains. I was there the entire time in the room with the General. The others you mentioned, you are correct, I was not there. I was at the breakfast on April 12th, and was in the room with the General during the entire event that weekend. I was also asked to give CSX Vice President MR Clarence Godden the tour of the museum and enplane any questions he had about the locomotive General, During the 2012 Great Locomotive Chase Descendents Party, I was asked to be there both days, and I was. Robert Jones and I are also leading a bus tour up the W&A Railroad tomorrow for a museum event. Does it not seem strange to you that Harper was not asked to do these things? I am absolutely awed by the people defending Harper. Seems to me you folks have the same excuse for him that Obama has for his failures, " BLAME IT ON BUSH".

Well Joe its obvious by your posts that you have felt somewhat jilted in the fact your not getting the recognition you feel you deserve for your service to the museum. Its a shame that in your desire to become noted, you felt that you needed to come boost your own self image by the use of such disparaging remarks to a well loved employee like Harper. So do you wonder if you were forced off the foundation and out of the museum. Would the paper do an article on you? Would people come sing your praises?

If any of you people want to attack my record at the museum, please be person enough to give your name. I have done as much for that museum as a volunteer and an unpaid foundation member as Harper has. you people have no idea about what you are talking about. And, I did not stab Harper in the back. I talked too him numerous times to try to talk some sense in his head. Ask him, I took him to lunch and begged him to conform and his words to me were, "I ain't taking orders from these little girls." If any of you have the guts to speak to my face, do it. You are a bunch of opinionated cowards who hide behind fictitious names. If Harper had as spent as much time trying to keep his job as he did whining to everyone about how they were after him, he would have still been employed there. By the way, Robert Jones and I will be leading bus tours Wednesday up the route of the Great Locomotive Chase and we both spoke at the decedents party for the decedents. We get along fine without Mr Harris.

First, don't know any of these people, but if this employee was such a racist, pornographer slacker,insubordinate,who lacked the ability for filing paperwork, then how did he make it 15 years? What was done to correct this? Was he offered training in these areas to become more efficient in these areas or just given a piece of paper and told to do better? Maybe this would have not gone on for 15 years. Was he really a bad employee or a victim of government bullying, which takes place every day? I have friends who have worked in the government world and stated they are always reminded daily they are lucky to have a job.

Secondly, if I read this right, why didn't this Drobney guy? Who was his past supervisor, before being promoted to Asst. City manager, Why didn't he take disciplinary action as far as termination? I can't believe all of this was done in 90 days or was it?

Lastly, I have been reading the paper and Kennesaw sure seems to have been the topic of discussion lately. Is the Mayor and Councilmembers that out of control or their underlying that out of control? Well best of luck to all parties involved because either way somebody will not be happy.

One last comment, is normal that an empolyee have to appeal to a Judge that gets paid from the city? Who do you think he is going to side with, since his pay check comes from the city? Seems like a conflict of interest for all parties involved, both employees fearing for their jobs..i.e. Judge and employee...Best of luck

I am interested in why nobody has lent any comments on why, this had went on for so long without earlier termination. I believe its because its from lack of supervision, negligent retention and so on...Sounds like some issues had been discovered and now the city maybe looking at how to defend it..problem is nobody wants to mention anything about negligent behavior on the cities part of the city officials...Again, good luck to all...

Harpers pay does not compare to the salary of the other city employees. Check out Kennesaw Watch. There are salary amounts for several City staff. Research should be done before judgement. The City of Kennesaw's history over the last 5 years is certainly questionalble. Law suit after law suit, firings, new staff? What about the financial loss the Museum is costing the City. Personal City counsel projects not budgeted cost the City lots. Seems out of control!

I have never seen such an injustice committed by city government as I witnessed at Mr. harris's "hearing". Harper has contacted myself as Well as many others in the collecting field about making loans and donations to the museum. I recently loaned my cannon for the camp McDonald event and signed a loan agreement write Mrs. Bush. When i returned for it they had no idea where it was. If I bad checked my voicemail I would have known that Harper had it taken to my friends house for safe keeping. The lack of concern on the management staff for a $30,000 cannon demonstrates to me Who should really be fired. I will further add that maybe Mr. Bozeman will be willing to step up and procure loans, but they wont be from me, I am done!

Scott, this very interesting. I would like to here this entire story. Would you please share it with us? If Harper sent a loaned article to the museum to someone other than you, this is a serious charge. If that agreement was signed by both you and the museum, Harper was in violation of policy if he removed it from the possession of the museum. And as far as me stepping up and acquiring things for the museum, I have been doing that for several years now. I have been instrumental in bringing the Bogle collection to our museum. The story of your cannon sounds like another example of Harper doing exactly what he wanted to with no regard to museum policy. I recently delivered two Western & Atlantic Railroad mile markers to the museum from the Bogle collection. They had been in the ground for many years and were very dirty. I and another volunteer cleaned them. I asked to move them from the museum for cleaning. My request was denied because museum property or loaned items cannot leave the property. This sounds like another example of Harper playing by his rules and not those of the museum.

I am on the museum foundation and a volunteer there. I am probably in the museum more than anyone but full time employees. Harper Harris being the face of the museum and the most knowledgeable person about the General and Keneesaw history is nothing but hogwash. If these nasty comments and personal attacks on elected officials and museum management don't stop, I will present facts on this site showing that Harper Harris should have been terminated long ago. To quote the most knowledgeable person of the General, "He is a loose cannon, made 19 mistakes in a documentary about the General, and why does the museum put up with him." Now, please stop all this bashing of the museum. I have the above quote on a video tape made of Colonel James G. Bogle in January 2010. To any of you who don't know who Colonel Bogle was, he was the co author of the book, "The Texas and the General", supervised the restoration of the Locomotive Texas, wrote the narration of the chase in the pedestrian tunnel, and at his passing almost two years ago had forgotten more about the subject. that Harper will ever know. He also said, that Harper just yaked, yaked, yaked and said very little of substance, but I did not record that. I know what I am talking about, so the rest of you can just shut the heck up. I know for a fact that Harper was given every opportunity to conform to museum expectations and did not do so.

No doubt about it, if there was something sneaky done, it involved Cris Welsh. Has anyone noticed that since she was elected to council all of these problems have come up? She protects the city manger in spite of her previous promises to really look at what his management was like. She's even going after our Mayor now. Can you say ego?

Everyone seems to be getting so caught up in whether he was or wasn't "the face" of the Museum. One person is not representative of an entire organization and to state that he is, diminishes the hard work of the whole team. That being said, someone needs to take a look at all of the changes taking place at the museum, aside from this one person.

Many long time employees have left (for whatever reason) right after Banz came onto the scene. Why is that? There has been 100% turnover. In the corporate world, that is an unacceptable rate and it tells us that something is seriously wrong.

Take a look at everything surrounding Kennesaw in the news lately. What should be looked at is not whether Harper Harris stays or leaves but how the council is going to stop the bleeding and when they are going to get rid of this city manager who is running this circus.

Funny - most of the folks critical of Mr. Harris seem to have no personal knowledge of anything. It's the old "If someone in authority says it, it must be true". I don't but into that. That's why it is before a Judge now - to find what is fair, equitable, and true. How much of what he is accused of is accurate? I guess we'll get a better idea in the next 7 days.

All you folks who can't believe Harper Harris actually did alot of things, especially in the last 8 years, trust me. I was there, I saw it and it's real. Harper comes off as a "good ole boy," but actual is someone who didn't perform anywhere close to the standards and others had to do his work for him.

I also know that Jeff Drobney could have taken control of this years ago, but was too interested in building his own career (Asst. City Manager). When Richard Banz came in he was to act as a hatchet man and get rid of everybody and has done that.

As far as Harper goes, he will be missed by his good buddies and the public, but not by his fellow employees.

Take it from a former employee, (quit last Sept.), most of the charges made against Harper Harris have been taken out of context (see Call It Like It Is- for the truth).

Harper is responsible for bringing many permenant, long term and temporary exhibits to the museum. He is also responsible for thousands of dollars in monetary donations coming into the organization. He has delighted children, seniors, clubs, and families for years with his passionate telling of The Great Locomotive Chase and other stories of railroad and Civil War history at the museum and thru out-reach programs.

Harper was the soul of The Southern Museum. The article title was no exaggeration. It is truly the end of an era.

First and foremost the charges brought against Harper are beyond bogus. I too have been a volunteer at the museum and have never ever seen Harper be rude or crude to anybody at anytime. If anything he is a true southern gentleman. The so called Porno was something that was sent to him by e-mail which was about 5 years ago. The noose was just something he threw together in his own office to which no one would ever see and was not meant to offend anyone. Sometimes a knotted rope is just that. In reference to weapons there was no loaded guns. Harper left a black powder rifle setting beside the case. People if you know anything about this kind of gun, there is 0 chance that is could be accidentally loaded and fire. What they fail to tell you is there was no black powder around for anyone to even try to load the gun. Banz is a head hunter pure and simple. In his time we lost our education dir, our curator, store manager, the entire front staff. Bush is a very small little tyrant who doesn't have half the knowledge that Harper has yet she becomes the boss of a 15 year employee. This could have been avoided if Kennesaw had a city counsel with backbone and the museum trustees acted on it. Now you have lost a great guy and caused tremendous amounts of damage. MJD you should look further into this and start at the top with Jeff Drobney, does he really have a PHD? Look into it.

I understand that Drobney's 1995 Ph.D. was rescinded due to plagiarism. I think Banz's degree is in education, which means he knows a lot of theory but little else. Do you really want these two in positions of leadership? This museum will never be taken seriously as long as they are in charge. As for Harper Harris, noboby is perfect. You can find dirt on anybody if you try hard enough. This is obviously a witch hunt conducted by dull-witted administrators who need to get rid of someone who because of his natural skills makes them look bad.

Concerned Historian: Please don't try to call yourself a "historian." Drobney helped build and raise the funds for the museum and without him it would still be a storage closet. Your "claim" about his credentials is purely ficticious, slanderous and easily verifiable. A true "historian" would never put such a comment on a blog without checking the true facts. Plus, a true "historian" would have posted his name and not hide behind a label. Call yourself what you are "uninformed"

Without Mr. Harris or someone of his caliber the museum will be little more than a storage building. My grandson attended the excellent day camp Mr. Harris ran last year and was delighted. Ms. Bush had no idea what the program would be just days before it began this year. We opted out based on the dismal program that was planned.

I am a former employee of the Southern Museum, where I worked with Harper Harris for 4 1/2 years. During that time I personally witnessed the incidents mentioned in your article. The accusations are not false. What IS interesting is that when these behaviors were brought to the attention of BOTH executive directors, they were not acted upon. Employees often had to fill in for Harris when he was tardy or just didn't bother to show up for scheduled programs assigned to him.

Mr. Banz stated shortly after his arrival that he was brought in to be the "hatchet man". It is interesting to note that under Mr. Banz's "leadership", 5 part-time employees were laid off; consequently, 3 full time staff and 2 part time staff members resigned, all within less than a year. It appears that Ms. Bush's position was created for the sole purpose of "cleaning house" and ridding the museum of the remaining "problem employees".

I know for a fact of a recent incident where the museum booked him for different programs which overlapped at the same time. Both the Big Shanty Festival and a tour at Allatoona Pass. Harper did his very best to make it to both of the obligations. Once again setting him up for failure for both events to build the "evidence" against him.
